1. ACCEPTANCE OF TERMS AND BINDING AGREEMENT

This Terms of Use and Service Agreement ("Agreement") represents a definitive and legally binding contract between Orbtickets LLC, doing business as cruise-vacations.com ("the Company"), and you, the user ("User"). By utilizing our Site or Services, you acknowledge that you have read, understood, and unequivocally agree to be bound by these terms.

2. DEFINITIONS AND GENERAL INTERPRETATION

2.1. Company: Orbtickets LLC / cruise-vacations.com.
2.2. Site/Services: The website located at https://cruise-vacations.com/ and all associated API integrations.
2.3. Third-Party Cruise Providers: Independent maritime companies (e.g., Royal Caribbean, Carnival, etc.) that provide the actual travel services.
2.4. Booking: The process of selecting and confirming travel facilitated by the Company.

3. NATURE OF SERVICE AND AGGREGATOR DISCLOSURE

3.1. Aggregation Role: WE DO NOT OWN OR OPERATE THE SHIPS. The Company functions exclusively as an online intermediary and authorized selling partner.
3.2. Contractual Relationship: The final travel agreement is solely between the User and the specific Third-Party Cruise Provider.
3.3. Liability Disclaimer: The Company disclaims all liability for maritime breaches, vessel delays, or personal injuries resulting from the acts of Third-Party Cruise Providers.

4. BOOKING, CONFIRMATION, AND FINANCIAL TERMS

4.1. Accuracy: Users are responsible for providing legal names exactly as they appear on passports.
4.2. Pricing: Prices are subject to change based on vessel availability until the formal booking confirmation is issued.
4.3. Boarding Passes: Our confirmation is not a boarding pass. Users must accept the Cruise Line’s official Passage Contract upon check-in.

5. CANCELLATIONS, AMENDMENTS, AND REFUNDS

5.1. Governing Policies: Cancellations are governed by the specific terms of the Cruise Provider (e.g., Royal Caribbean).
5.2. Service Fees: The Company may charge a non-refundable administrative fee for processing changes, separate from cruise line penalties.

6. USER OBLIGATIONS

Users must use the Site for lawful purposes and abide by all onboard codes of conduct established by the Cruise Line.

7. INTELLECTUAL PROPERTY

All content on the Site is the exclusive property of Orbtickets LLC. Users are granted a limited, revocable license for personal, non-commercial use only.

8. DISCLAIMER OF WARRANTIES

Services are provided on an "AS IS" basis. We make no warranty regarding the suitability or safety of vessels operated by third parties.

9. LIMITATION OF LIABILITY

Total liability shall not exceed the lesser of: (A) Service fees paid for the specific booking, or (B) One Hundred US Dollars ($100.00 USD).

10. INDEMNIFICATION

The User agrees to hold the Company harmless from claims arising out of your use of the Site or breach of this Agreement.

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1. Law: Governed by the laws of the State of Florida.
11.2. Arbitration: Any disputes shall be settled by binding arbitration in Winter Springs, Florida.
11.3. Class Action Waiver: All claims must be settled on an individual basis.

12. GENERAL PROVISIONS

Includes Severability, Force Majeure (acts of God/maritime accidents), and the Company’s right to amend these terms at any time.

13. ACCREDITATIONS

Orbtickets LLC is a FL Seller of Travel Licensed entity and a member of TRUE, CLIA, and ASTA.
